1. General

Garaga Inc. (“Garaga”) owns and operates this website (the "Website"). Garaga recognizes the importance of protecting personal information and is concerned about how it treats such information.

It therefore agrees to collect, use, communicate and retain only the personal information required to carry out its activities and for business purposes.

Garaga has adopted a policy on the protection of personal information, applies it in the course of its business, and has designated, in accordance with the Access to Information and Protection of Privacy Act (the "ATIPPA"), a person who is responsible for the protection of personal information and privacy within its company, the Privacy Officer. The identity and contact details of this person are listed at the end of this section.

This Privacy Policy describes the type of personal information that is collected, how it may be used and with whom it may be shared. Garaga's Privacy Policy also describes the measures taken to protect the security of this information and how you can access, modify or delete your personal information.

2. When and how personal information is collected

In the normal course of its activities and in the course of its business and delivery of services, Garaga collects certain personal information necessary for these purposes or for any other compatible purpose if the criteria of the ATTIPA and other applicable laws and regulations regarding the protection of personal information are met (collectively, the "Act"). Personal information may also be collected by Garaga in the context of employment, getting to know its clientele, debt collection, consulting and other business relations.

Personal information collected by Garaga may relate to the identity, contact information, health, social or family situation, employment, recruitment, financial information, training or education of the individuals concerned, depending on the nature of the relationship between the latter and Garaga. Identification documents containing personal information may also be collected by Garaga.

Garaga takes care to ensure that the individuals to whom this personal information relates are informed of its collection and that they understand the purposes for which it is collected.

Garaga may collect personal information through the use of technology that includes functions to identify, locate or profile an individual. In such cases, consent in accordance with the Act will be requested from the person concerned. Information on the use of our Website and other technical information or information on the interaction of a Website visitor may be collected (see point 3 of this section concerning Cookies and other information related to the use of our Website).

In cases where personal information collected by Garaga is communicated to it by a third party, namely a person other than the one to whom the information relates, the person who makes the communication must ensure that he or she has obtained the consent of the person to whom the information relates and has given him or her prior notice of the communication.

Please do not provide us with any personal information of third parties during the use of our Website without first obtaining their express consent to such disclosure.

3. Cookies and other information related to the use of our Website

Our Website uses a technology known as "cookies". A cookie is a tiny piece of data that our Website can send to your browser, which may then be stored on your hard drive so Garaga can recognize you the next time you visit. Cookies are used to help identify which parts of our Website are useful and which parts need improvement, which helps Garaga plan future improvements to its website. You may set your browser to notify you when you receive a cookie, or to block cookies. However, if you choose not to accept cookies from our Website, you may not be able to take advantage of all the features it offers.

A technology called "web beacons" may also be used. This technology allows Garaga to know which pages of our Website you visit. In addition, it is used to optimize and tailor our Website for you as well as for anyone who visits it in the future.

The IP (Internet Protocol) addresses of all visitors to our Website are collected, along with their browsing history and other related information, such as the websites you visited immediately before and immediately after visiting our Website, web page queries, browser type, operating system, the Internet service provider you use and the average time spent browsing our Website. This information is used to manage our Website, monitor and improve services and our Website, determine how our Website is used, identify popular areas and analyze trends and usage patterns.

4. Purposes for Using Personal Information

The personal information collected by Garaga is used to provide its services and, in certain cases, to meet legal obligations arising from the Act. Personal information collected by Garaga may also be required to meet its contractual obligations to its customers and other third parties.

Garaga may use your personal information to occasionally send you information about its products and the products of its partners, as well as other company news. In accordance with section 6 below, you may unsubscribe from these communications at any time.

Personal information may also be shared internally and with dealers and affiliates to enable Garaga to respond appropriately to your requests, communicate with you for the purposes described herein or otherwise assist you, as described above.

Garaga will retain your personal information only as long as it is required for the purposes for which it was collected, and will delete or destroy such information once those purposes have been fulfilled and the personal information is no longer needed.

5. Accuracy of your personal information

In order to assist you in a professional manner, the personal information collected must be accurate, complete and up-to-date. You may access, update and correct any inaccuracies in your personal information under Garaga's control and custody by sending an email to info@garaga.com.

6. Withdrawal of consent to collection, use and disclosure

You may withdraw your consent to the collection, use and disclosure of your personal information at any time by sending an email to info@garaga.com. However, if you withdraw your consent, Garaga may not be able to continue to respond to your inquiries, process any requests made of it, or otherwise assist you in connection with our Website. With respect to marketing communications in particular, you may choose whether or not to receive such communications from Garaga and its dealers and affiliates. You may change your preferences regarding commercial communications at any time by clicking on the "unsubscribe" link at the end of any email sent to you by Garaga and its dealers or affiliates, or by sending an email to info@garaga.com and stating that you no longer consent to receive email, direct mail and/or telephone communications.

7. Circumstances under which Garaga may disclose personal information

It may happen that Garaga communicates the personal information it holds to third parties, in particular to companies that act as subcontractors for Garaga or as service providers. These third parties may, in some cases, be located outside the province of Quebec, so that the personal information Garaga collects and holds may be located in a jurisdiction with a different applicable legal system than that of Quebec.

The contracts that Garaga enters into with third parties require them to maintain the confidentiality of personal information and, in particular, require them to respect the legal framework applicable to Garaga with respect to the protection of personal information and privacy.

Subject to an exception provided for in the Act, consent will be requested from the individuals concerned by the personal information if Garaga were to communicate to third persons personal information that is not related to its current operations and activities or that is not compatible with the purposes for which it was collected.

It may also be possible for Garaga to communicate certain personal information it holds as part of a commercial transaction or in other cases provided for in the Act. In the event that the circumstances of the communication are such that Garaga does not have to seek the consent of the individuals concerned by the personal information, it will comply with the requirements of the Act to proceed with such communication.

Furthermore, Garaga may be required to communicate certain personal information it holds to government authorities or law enforcement agencies

8. Security measures taken by Garaga with regard to the personal information it holds

Garaga implements policies and practices concerning the governance of Garaga and the protection of personal information.

Personal information held by Garaga is kept in secure locations, in accordance with generally accepted practices, and access to this information is limited to employees who require access in the course of their duties.

Garaga employees are made aware of the importance of protecting personal information and of the measures to be taken to ensure the confidentiality of such information. As part of their duties, employees follow procedures that protect the confidentiality of personal information and promote best practices in this area.

Garaga ensures the protection of personal information as soon as it is collected and implements security measures to protect it against use that does not comply with current legislation, to avoid accidental loss, unauthorized modification, disclosure or access, misuse or any form of illegal use. However, Garaga cannot guarantee that the personal information it collects will be protected against any attack.

9. Locations where personal information collected by Garaga is stored

Personal information collected by Garaga may be held or transferred outside the province of Quebec, including to countries other than Canada, whose rules regarding the protection of personal information differ from those of Quebec and Canada. When information is located outside Quebec or Canada, it is subject to the laws of the country where it is located and its collection, communication, use and destruction may be carried out differently from provincial or federal requirements.

10. Length of time personal information is kept

Except as authorized or required by applicable law, Garaga retains personal information only as long as necessary to fulfill the purposes for which it was collected, including to meet ethical, legal, tax, accounting or appropriate government notification requirements. Once the retention period has expired, personal information is destroyed, deleted or made anonymous. Information that has been made anonymous can no longer be used to identify the person concerned.

In the event of a confidentiality incident involving personal information, Garaga follows the provisions of existing Act and takes reasonable measures to mitigate the risks of harm being caused to the persons concerned by the personal information targeted by the incident.

11. Links to third-party sites

Our Website may contain links to other websites not owned or operated by Garaga. Unless otherwise specified herein, none of your personal information will be disclosed to these third parties without your consent. Such linked websites may contain separate and independent privacy statements, notices and terms of use that you should read carefully. Garaga has no control over these websites and therefore has no responsibility or liability for the manner in which the organizations that operate these websites may collect, use or disclose, protect and otherwise treat your personal information.

12. Updates to our Privacy Policy

Garaga may revise this Privacy Policy from time to time. If Garaga decides to change its Privacy Policy, the revised version will be posted here. To ensure that you are aware of the most current privacy terms and conditions, we suggest that you periodically visit this Privacy Policy page.

13. Policy complaints

An individual who believes that his or her own personal information or that of another individual has been subject to:

  • access not authorized by the Act;
  • a use not authorized by the Act;
  • a communication not authorized by the Act;
  • a loss or any other violation of the protections set out in the Act

is invited to submit his or her complaint in writing to the Privacy Officer identified below.

The complaint must include the relevant details, i.e., the personal information concerned, the context, the potential or actual harm suffered or that could be suffered, and the relevant dates. The details of the reported incident should be described as accurately as possible, so that action can be taken quickly.

Any employee who receives a complaint knows that it must be transmitted to the Privacy Officer as soon as it is received.

Upon receipt of a complaint, Garaga follows its internal procedure for handling complaints, in order to treat the complaint fairly.
